#1          GAIC proposed Constitution


Be it resolved that

the current Constitution (consolidated as of June 1, 2008; amended June 19, 2009) of the British Columbia Confederation of Parent Advisory Councils (BCCPAC) be deleted in its entirety and be replaced by the amended Constitution (dated September 6, 2010), as posted on the BCCPAC website.

Be it resolved that
 

the current Bylaws (consolidated as of June 1, 2008; amended June 19, 2009) of the British Columbia Confederation of Parent Advisory Councils (BCCPAC) be deleted in its entirety and be replaced by the amended Bylaws (dated September 6, 2010), as posted on the BCCPAC website.

1. A.   GAIC Proposed Constitution
 
Section 1 & 2 of the Constitution be rescinded and replaced with the following:
 
The name of the Society is "B.C Confederation of Parent Advisory Councils" and is commonly referred to as BCCPAC.
 
The purposes of the Society are:
a.   To support the success of all students in public education in British Columbia at the school, school district and provincial levels;
            
b.   To promote, support and advance meaningful parent participation throughout the public education system through 
leadership, communication, cooperation, and representation.

1. B. 2.   GAIC Proposed Bylaws 
 
The existing BCCPAC Bylaws Consolidated as of June 1st, 2008; Amended June 19, 2009 be rescinded with the Proposed Bylaws dated March 31, 2010

2.   Motions advocating change in the education system
 
The Bylaws be amended to provide that resolutions that advocate for change in the education system will require 60% of the votes cast in order to pass.

3.   Vacant positions to be immediately filled at the AGM

As a special resolution that bylaws 5.12 and 5.22 (or the corresponding bylaws should a revised Constitution and Bylaws be passed prior to this resolution) be rescinded, and replaced with the following:
 
5.12   A member of the Board who is in the first year of their term and who wishes to run for a different position (e.g. First Vice-President running for President) shall be permitted to do so without resigning or taking a leave of absence.  If the Board member is successful in his or her campaign then the position she or he previously held becomes vacant and the members may immediately elect another person who is qualified under the bylaws to fill the vacancy.  If the person is unsuccessful in their campaign they shall continue in their original position for the remainder of their term.
 
5.22   The members may by special resolution remove a Board member before the expiration of his term of office, and may immediately elect another person who is qualified under the bylaws to complete the terms of office.

4.    Parents' Entitlement and Responsibilities

That BCCPAC urge the Ministry of Education to advocate for the amendment of the School Act Section Change Term of  7 (1) (a) to read
 
Parents' entitlement and responsibilities
7 (1)   A parent of a student of school age attending a school is entitled
   (a)   to be informed, in accordance with the orders of the minster, of the student's
          attendance, and progress at school
   (b)   to be informed and included in decisions made regarding the behaviour of the
          student
   (c)   on request, to the school plan for the school and the achievement contract for
          the
          school district, and
   (d)   to belong to a parents' advisory council established under section 8

5.   Increase of BCCPAC Membership Fee

BCCPAC increase its membership fees to $75.00 per year to take affect for the 2010-2011 year

6.   Students as Couriers

BCCPAC urgently contact the Ministry of Education to request legislation that will prevent students from being used as couriers for materials intended for their parents.  The only exceptions should include official communication from the Ministry of Education, school boards, principals, parent advisory councils and school planning councils.
 
AND BE IT FURTHER RESOLVED THAT BCCPAC inform our education partners of our expectation that this practice will not continue.

7.   Gaming funding Information

BCCPAC urgently contact the Ministry of Housing and Social Development to obtain their commitment to inform BCCPAC, DPACs and PAC's what the funding formula will be for their annual Community Gaming Grant by April of every year for the upcoming year.

8. Sun Protection Policy

BCCPAC advocate for a Sun Protection Policy in all school Districts.

9.   Funding for non-designated students in need

BCCPAC urge the Ministry of Education to mandate School Districts to pre-screen all new Kindergarten students as well as providing ongoing appropriate assessment for all students, as needed, including for learning and behavioural challenges, so that students who qualify for Ministry funding and/or IEP's can be formally assessed, have designations put in place, and have learning interventions implemented in a timely manner.
 
And that Ministry of Education is to work with other ministries to ensure adequate funding for this initiative

10.   Updating Designations
 
BCCPAC urge the Minster of Education and the Provincial Government to review and re-classify the level of designation so that additional learning differences including but not limited to ADD/ADHD, developmental delay, sensory disorders be recognized, acknowledged and funded accordingly.

11.   Responsibility for the care of School Children after and Emergency or Evacuation 

BCCPAC request a Ministerial Order, similar in concept to the BC Ministry of Education Anaphylaxis Protection Order, stating that the Ministry of Education and School Districts, as part of their emergency mitigation and response policies and plans, adopt the North American and province wide Incident Command System used by Emergency Services and government organizations to assign responsibility for the supervision and care of their students both during and after an emergency incident or disaster in their area and until such a time as the students have been picked up by a parent, guardian or authorized adult.

12.   (previously #16)   Student Records
 
That BCCPAC advocate for processes, policies and/or legislation that provides for the following with respect to student records:
  • Parents immediately receive a copy of the following materials by mail, email or in person when added to a student record:
       *   Student Learning Plans
       *   Individual Education Plans
       *   Formal or informal assessments relating to any type of learning disability or
           designation
       *   Student Behaviour Management Plans
       *   Student Safety Plans
       *   Documents critical of a student or in the nature of discipline
  • Student and Parents are provided an opportunity to attach a written rebuttal to any material critical of a student and any such rebuttal will be added to the student records.

13.   (previously #12)   Advocating for Students' Rights

BCCPAC advocates for the rights of students in the public education system as the need arises with respect to systematic issues.

BCCPAC advocates for the equal rights of students when other stakeholders in the public education system are exercising their own rights

15.   Intervenor Status for Status and Parents

BCCPAC advocates for Intervenor Status rights in quasi-judicial and labour dispute processes to ensure that their position may be heard when the judgement on a particular case may affect the individual or group of students or parents
